The terms that govern your clinic's use of the Apex Vet platform. Written in plain language.
These Terms of Service govern your clinic's use of the Apex Vet platform, operated by Apex Vet in Australia ("Apex Vet", "we", "us"). By subscribing to or using the platform, your clinic ("you") agrees to these terms. If you do not agree, do not use the platform. These terms work alongside our Privacy Policy; where we act as a data processor for your clinic, a separate Data Processing Agreement also applies (see the Security & Trust page).
Apex Vet provides software for veterinary clinics, including online appointment booking integrated with your practice-management software, the Apex Vet Assistance AI consultation assistant, and related features. We provide the platform on a subscription basis and may add, change or remove features over time. Some features are described as in development or roadmap and are not guaranteed by a specific date.
Apex Vet Assistance produces draft clinical notes, summaries and suggestions using artificial intelligence. These are decision-support tools only. The treating veterinarian remains solely responsible for all clinical decisions, diagnoses, prescriptions and records. Apex Vet does not provide veterinary advice and is not liable for clinical outcomes arising from reliance on AI-generated content that has not been reviewed and approved by a qualified professional.
Subscription fees, billing frequency and any per-seat charges are set out in your order or confirmed during onboarding. Fees are exclusive of GST unless stated otherwise. Late or failed payments may result in suspension of the service after reasonable notice.
The platform integrates with your practice-management software and relies on third-party providers (for hosting, messaging, transcription and AI). Your use of those integrations is also subject to the relevant provider's terms. We are not responsible for the availability or accuracy of third-party systems, including your PMS, but we will use reasonable efforts to maintain working integrations.
We aim to keep the platform available and reliable but do not guarantee uninterrupted service. We may carry out maintenance and will give reasonable notice of significant planned downtime where practicable.
The Apex Vet platform, software and brand are owned by Apex Vet. You retain ownership of your clinic's and your clients' data. You grant us the limited rights needed to operate the service for you, as described in the Privacy Policy and Data Processing Agreement.
Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded. Subject to that, our liability to you is limited to the fees you paid in the 12 months before the relevant claim, and we are not liable for indirect or consequential loss. This does not limit either party's liability for matters that cannot be limited by law.
Either party may end the subscription in line with your order terms. On termination we will, on request and within a reasonable period, provide an export of your data and then delete or anonymise it, subject to any legal retention obligations.
We may update these terms from time to time. Material changes will be notified to clinic account holders. Continued use after a change takes effect constitutes acceptance.
